2:11 consumption mess has been explored by Tom's Hardware and we've got John here
2:17 to specially cover a legal topic that we
2:20 wanted to get into uh which one was it where is it where is it Zillo the Zillow
2:25 uh copyright infringement case which sounds a lot less interesting than it
2:30 actually is there we go Zillow massive website tries to sue uh
2:37 satirical blogger over photos that Zillow doesn't even own so brilliant so

3:54 have my HDMI cable plugged in and somehow I managed to my muscle memory

4:26 see on the uh screen grab there site called uh mcmansion hell and for those
4:32 of you who don't know or probably mostly people not from the US or what's a McMan
4:37 a MCM is a large yet relatively cheaply
4:42 built house it was um they were building them all over the place in the US before
4:47 um the housing bubble burst in the late 2000s and uh they're they're larger but
4:52 like I said slightly cheaper cheap more cheaply built built houses and so this
4:58 um this blogger started this website called mcmansion hell and this blogger
5:02 is I think an architectural student so she was going through and posting all
5:07 these pictures of homes that she
5:10 considered to be mcms and telling people oh these are terrible buildings that
5:15 have terrible architecture here are the reasons why and this is a regular blog
5:18 that she updated sounds pretty funny yeah it was pretty popular she had lots
5:22 of visitors um who liked her sort of snarky take on oh LOL you could scrape
5:27 these Windows off with a paint knife this is terrible um so she got a lot of these pictures
5:31 from Zillow which is like this huge sort of like real estate site if you want to
5:35 sell your house a lot of people use Zillow to post pictures of the house on
5:38 there so sure okay yeah anyway Zillow
5:41 got wind to this and they so they sent her a very angry cease and assist letter
5:47 saying oh you're infringing our copyrights and you can't do this and
5:51 this and that so um so this kind of blew
5:54 up she freaked out she's like my is at stake so yeah so so she could lose her
5:59 job but Zillow didn't take these photos
6:03 no they didn't which is like a huge Wrinkle In this case so the photos that
6:08 um people like they upload them to Zilla right so if you want to sell your house
6:13 you take your own photos of your own house and you upload them the photos are
6:16 yours and when so I had a look at take
6:20 your own photos what are we doing here that's what you sound like sorry go ahead that's what I sound like okay

7:03 those lines and okay so if you look at
7:07 if you look at if Zillow can even Sue because that's the big one of the big
7:10 questions it's like do they even have standing to Sue and and standing laws of
7:15 it's kind of a simple concept to understand right it's if you're going to take someone to court you have to be a
7:21 party to whatever the dispute is if someone walks in here and punches lonus
7:25 in the mouth and knocks a few of his teeth out yeah I can't see neighbor well
7:30 maybe you could your my livelihood is at
7:33 stake because my boss can't come to work
7:36 and shoot the videos that I write therefore but so yeah it's a bit more
7:40 tenuous but but if let's say you were some complete freaking random yeah yeah
7:46 you can't sue because you have nothing at well well if someone okay suppose
7:51 that lions and I were just friends and we're walking down the street together
7:57 friends suppose someone comes up to him just punches him in the face I can't sue
8:03 that that guy on Lion's behalf he has to do it himself so the concept is that how
8:09 how the concept applies here man I've had way too much caffeine just all over

8:16 is that the fifth circuit which is was no it was the ninth I'm sorry but the
8:20 ninth circuit in the US very influential appeals court right below the Supreme
8:23 Court yeah uh there was a case from a couple years ago where they ruled that
8:28 you have you can have standing to sue about infringement of someone else's
8:32 copyright only if you have some sort of exclusive right which in their own terms
8:38 of service do not have right if I don't
8:41 know if it says nonexclusive specifically but but it doesn't
8:45 specifically say it's exclusive what you would have to do correct so so this is
8:50 whether they even have standing to sue the MCM hell blogger is very very very
8:56 unclear I would my if I were to Hazard a guess I would say they do not but it
9:01 didn't stop her from being embroiled in this big legal battle she's got some
9:04 pretty prominent IP lawyers on her side right now but um it's it's an
9:09 interesting question about you know who gets this could affect dank memes
9:13 forever it absolutely could who gets to use Pepe which is which is why this
9:18 conversation is important by the way which is why we're having it on L show
9:22 but honestly I'm still not over how lowkey burned I just got about a minute

10:47 about this is that even if some Court said that Zillow has standing to sue
10:52 which I doubt but if it gets to that phase yeah um one of the biggest things
10:56 that courts look for whether to determine if a use of the copyrighted
11:00 photo or something is fair use that turn gets thrown around a lot fair use is the
11:05 effect on the market for the work who the heck is going to like start selling
11:10 their random pictures of their random mcmansions and make tons of money off of
11:14 them right you know so and I think so there's a there's a strong argument I'm
11:18 not saying it'll win necessarily but there's a strong argument saying there's
11:22 no real market for these pictures as being affected right so she wants to
11:25 argue fair use but again like I said there's a standing issue may not even get to that point so okay got it yeah
11:31 there there's multiple Hoops to jump through in in law if you've ever fought a traffic ticket I'm sure you've figured

11:59 ever talked about this thing before I know we haven't on the channel have we

12:10 I'll give you a really quick tldr um if
12:13 also if you've seen any of of of critical videos on YouTube I'm sure
12:17 you've seen this where he lampooned this ridiculous thing called the juicero and
12:22 it's it is a juicer that originally cost
12:25 $800 they've since dropped the price to$ 400 and now it's going to be down to
12:30 below 200 according to this article from RS Technica but all it is it's this
12:35 thing they ship you packets you know they look like they look like giant you
12:39 know hot or coold packets or whatever they cost about $5 to $7 each you put
12:45 them inside this thing you shut a door on it you press a button and it has to
12:48 be connected to the internet at all times it squeezes the juice packet and 2
12:52 minutes later you have the glass of juice that's literally what it does and
12:56 it originally sold for um seven or I think it was $700 but it was very
13:00 expensive okay so so apparently they've cut the price
13:06 already they've cut the price down to $200 and they've laid off a bunch of
13:10 their staff and my question is my
13:14 question was why it was so expensive to begin with and apparently this thing was
13:18 this it was ridiculously over engineered some website did a tear down of it and
13:23 it was a really really high build quality which is great but sorry a he's
13:29 a YouTuber oh a right okay A a did the
13:34 did the tear down is that right Luke okay so he did the tear down and the
13:37 thing was like I said absurdly over engineering all it was doing was just
13:41 squeezing a bag of like fruits and vegetables to make juice out of it um so
13:46 they decide to lower the price down to $200 but I'm wondering why not just get
13:52 an actual like baller juicer from Bed Bath and Beyond or somewhere or Amazon
13:57 for that price and you could even get like an Amazon Fresh subscription and
14:00 have the veggies and the fruits delivered to your door if you're too lazy to go to the store to buy them
14:05 instead of instead of
14:08 this I mean could you see is there a universe where you would find this
14:12 useful lus like if you wanted fresh juice after a bad mitton game or
14:16 something um so I have a Vitamix okay so
14:20 basically everything else can just get crapped
14:24 on so no so no there you go and the
14:29 stupid thing is that like as even at the
14:32 $400 price point you could get a used Vitamix which by the way will probably
14:36 run for like 50 years because those things are
14:39 unbelievable um for the same price and then you could put literally anything
14:44 like you could put a child in a Vitamix um we we don't advise you do that you
14:49 can put has never happened well I can't say it's never happened yes um it's
14:53 never happened to my children or in my presence or at my instruction there we
14:59 go am I covering all my legal bases right now I I I I think you are please

15:06 small children cry but please don't put them in the Vitamix anyway okay what

20:26 topic this is is actually like okay
20:31 little spicy so here's the thing you know you go hang around you know SLG or
20:38 whatever and you'll find you'll find plenty of hate for Intel and their
20:44 business practices and their Communications and you'll find hate for
20:49 anything Intel um but for the most part for the last
20:56 you know yeah eight or so years when they haven't really had
21:03 a real competitor um Intel has put on a
21:07 very good and it's up to you the
21:11 individual viewer to pick your next word this is like a Choose Your Own Adventure
21:15 book okay you can decide whether it's um
21:19 whether it's having a a pretty professional uh uh uh image or a pretty
21:26 professional facade it's up to you I
21:29 don't care but for the most part they've been fairly professional and fairly
21:33 dignified in their corporate
21:36 Communications and their slide decks in
21:39 their presentations to Partners and to
21:42 the Press so this was originally posted by

22:16 posted by tech power up here in an official slide deck posted the following
22:24 okay first of all there's some some debate in the
22:30 industry as to um a couple of things
22:34 number one as to how exactly Intel is
22:38 deriving these smt numbers so so that's
22:41 Intel's uh hyperthreading TM and amds
22:45 what what are they calling it I I don't I can't remember whatever something
22:49 something else but smt okay so um
22:53 symmetrical multi multi threading y so where you take one core and you feed it
22:57 a couple of threads so it can process both of them more efficiently than if it
23:00 had just processed one thread in the first place okay so it's unclear a
23:05 couple things number one how exactly they derive these numbers because they
23:09 don't necessarily align with what all the sort of tech media are seeing and
23:13 number two whether this is an applicable comparison in the first place because
23:18 Intel's basically taken a Zeon
23:21 6134 and they have run clock for clock
23:25 against a ryzen 7 desktop chip with
23:29 the clear argument being that this is a close analog because these are both
23:33 eight core 16 thread processors running at 2.2 gigz now to be clear
23:40 probably that comparison works fine
23:43 because contrary to what the people who got really confused by mine and Luke's
23:49 discussion about Vega Frontier Edition
23:52 contrary to what those people think architecturally Hardware wise oh yeah
23:57 the consumer grade stuff is often not
24:01 materially different from the Enterprise grade stuff sometimes you'll see better
24:05 binning a longer warranty you'll see more functional units enabled or you'll
24:10 see some some Flags enabled for features
24:13 that were turned off in order to artificially differentiate them that's
24:16 where most of the difference comes from so fundamentally Intel's comparison here
24:22 may not actually be that far off Hardware Hardware wise but that doesn't
24:27 change that there are other questions here as well what's the
24:32 Baseline uh that's one thing I really hate about these graphs single thre so
24:37 that's the other thing you don't know is single thread I guess so improvement
24:41 over Intel single thread improvement over AMD single I guess don't say
24:45 anywhere well there's more information on slide 20 to 21 okay so that's that's
24:49 fine honestly the negative 13% is just like what that's not well there are
24:54 situations where hyperthreading as well does result in a performance lost right
24:59 but I don't think we've seen that on ryzen we haven't but that specific
25:02 workload that who knows how Cherry Picked or not Cherry Picked it is
25:06 honestly that's not the thing that bothered me that much it's not that
25:10 unusual whether it's AMD Intel or NVIDIA to include some basic performance
25:14 comparisons when they're trying to make their product look good in a slide deck
25:19 this one is one of the ones that blew me
25:22 away where Intel basically gave
25:26 themselves a check mark for robust
25:31 ecosystem Decades of investment in software optimizations and validation
25:35 easier application de deployment for customers and some of the stuff on here
25:39 is just like
25:43 um okay hold on a second uh like hold on what okay so yeah
25:51 hold on hold on okay I'm trying to find something just totally stupid there were
25:55 there were a couple that were that were really dumb like where gigabytes on here
26:02 somewhere like what what software optimization are you doing with Gigabyte
26:07 on your new server chip that AMD doesn't
26:11 here it is so here's here's like Gigabyte on here because freaking or
26:16 something so then AMD doesn't get
26:20 Gigabyte on their list of Partners right
26:24 not even Gigabyte literally none who I'm pretty sure that AMD works with question
26:28 mark we didn't look into it not even super micro okay who I'm pretty sure
26:33 that AMD is working with on their uh
26:38 Naples product and by pretty sure I mean
26:41 you can you can bet on that um and the
26:45 list goes on and on I'm sure AMD has talked to
26:49 Microsoft okay I'm pretty sure that conversation is going going on right now
26:54 so they basically go ex they they take this quote
26:58 totally out of context expect software
27:02 optimizations needed for Naples just like ryzen which is fair but what Intel
27:07 ignores is that when they launch a new architecture software optimizations are
27:13 needed it is it is not even newsworthy
27:17 whether it's Intel or AMD for there to be an aatom I believe is the singular of
27:23 irasa okay RAM okay so some kind of
27:26 weird bug where the CPU needs updated micro code and needs maybe even a driver
27:30 fix in order to fix some kind of a weird Hardware bug that that stuff happens to
27:35 both of them and basically they're going to go they they've turned that into
27:39 AMD's ryzen CPU gaming perform oh yeah okay so they took so they took another
27:43 quote totally out of context ryzen CPU gaming performance inhibited by lack of
27:48 optimization so they're basically saying look software not optimized for their
27:53 four die peret implementation likely a multi-year investment effort to develop
27:57 optimizing inv validate an ecosystem that is is taking a nugget of
28:04 Truth and blowing it up into a movie
28:09 theater room filled with
28:13 popcorn and a nugget is not even a kernel that's how far off we are random
28:18 little tidbit I can't verify this because I I can't find them but
28:21 apparently there's two Hitachi hitachi's just listed twice oh seriously which is
28:26 just kind of funny here's Itachi hold on here we go okay where's the other one so
28:30 here's a Hitachi and here's a Hitachi so Intel works with Hitachi so much that
28:36 they Hitachi while they Hitachi so they can Hitachi while they Hitachi that yo
28:41 dog they're they're that hardcore on Hitachi I mean for all I know there's
28:45 multiples that are in there twice because I don't think anyone looked that closely at this slide no I don't think
28:49 legal looked at this slide or maybe maybe they did but they were just like
28:53 yeah I don't really understand oh no no I thought IBM was in there twice but no
28:56 yeah all right okay and you know what's the craziest part is this is that that's
29:01 not even where this ends no like that's not even the super hardcore part this
29:05 isn't no in my opinion no no this gets worse and once
29:10 again in these black and white terms

29:21 no this is like you know you know when you go to one of those like it's usually
29:26 slightly ghetto websites and they'll be like this is our product whole bunch of
29:30 check marks usually it's for like a video ripping software or right this is
29:34 their product no check marks they suck and sometimes it's on nicer stuff but
29:39 usually it's a little bit more granular and they'll actually show like yeah
29:42 their software does this thing but we do more of these things whatever but
29:46 usually it's the dignified way to do it whereas like the janky software way is
29:51 like has three red pixels in the bottom

32:42 lack of ecosystem they have no ecosystem
32:45 none at all it doesn't exist you can't you can buy the chip you can't put it in
32:49 anything there's no software for it there's no compatible hardware for

32:59 said look we've got a more mature ecosystem that's way more reasonable
33:04 we've been supporting the data center for the last 5 years in a way that AMD
33:10 has just been completely out of the game for we understand our customers better

35:11 bottlenecks on a many core Intel Zeon is
35:15 not a fair representation of exactly how
35:19 that works and they're saying here single die implementation maximizes
35:23 performance and in some cases that may
35:27 affect performance positively compared to AMD's approach but to call AMD's
35:32 approach which by the way these coherent
35:35 links matter and the way that every set
35:38 of Zen cores so there's eight per module here the way that every set of Zen cores
35:43 has a coherent link against every single other one freaking matters notice the
35:50 cross links in the middle that
35:54 matters and they they dro the glued together again glued together is not a
36:00 fair representation of what AMD is doing over
36:06 there unbelievable rough um so it it kind it kind of
36:12 actually goes on and on but I feel like we've spent a long time on this topic
36:17 and the the point is this is beneath
36:23 Intel this is not an appropriate
36:28 dignified way for them to respond they don't have to like even if
36:35 it like we've seen this before it's not like AMD has never blindsided Intel with
36:42 an architecturally and price to Performance
36:46 Superior product Athlon 64 and first generation
36:52 opteron came in and kicked ass in a way
36:57 that Zen actually doesn't like Zen is
37:01 competitive but not not as crazy as like
37:04 yeah yeah but it's not like AMD came out
37:07 of absolutely nowhere and took the
37:11 performance crown and even when AMD had the
37:16 performance Crown it took a long time
37:21 outside of the Enthusiast space and the
37:25 and actually I mean on server it it kind of went better than on the desktop but
37:29 it took a long time for AMD to claw back
37:33 significant enough market share that Intel couldn't launch Core 2
37:39 Duo and basically crap all over
37:42 everything AMD had achieved in a very short period of time from a business
37:46 standpoint not from a an industry disruption and and moving all of us
37:51 forward standpoint I mean they brought us 64-bit on the
37:55 desktop um so the fact that Intel is is reacting in
38:01 this kneejerk undignified fashion it
38:04 doesn't make business sense it doesn't make company image sense it might not
38:10 even make legal sense yeah that's a little rough the glued Together part is
38:15 like specifically an issue

45:34 to be 12 and 16 core processors they are freaking huge that is a real human hand

45:46 and said nope this stuff doesn't cost
45:49 that much PNG the pricing
45:53 for Wow Skylake X is is now looking a

46:02 perform but we know clock speeds the 1950x will apparently have a base clock

46:40 that doesn't matter because the overall die area under the spreader is so large
46:45 we're going to see coolers that are optimized to have heat pipes across as
46:49 many of those processing cores as possible and it should be potentially

47:09 combined with Intel's wos on x299 right now is further validation for all the

49:39 uh there's a huge cooling issue with the board but I don't VM vrm yeah the vrms
49:44 had a huge cooling issue that was a couple weeks ago um there's barely any
49:48 room for enthusiasts to overclock also many motherboards limit Skylake X CPUs
49:53 further due to poor design choices like I just mentioned such as sufficient vrm
49:57 cooling so this may be this may be the
50:02 dawn of the motherboard um full cover block oh hey
50:09 so that's like that's been a thing yeah but it's never really made sense because
50:13 so going back um going back to like the early 2000s it was pretty common place
50:19 for motherboards to have little whiny annoying fans on them and then right
50:24 around the time of like I guess uh

50:32 was the a8n 32 SLI
50:35 Deluxe slide Deluxe I can't remember what chipset that was I want to say

50:56 because you can install cards here right this SLI existed at the time um and we
51:00 did away with that and we moved towards this heat pipes that lie flat on the
51:05 board and carry all the heat up around the CPU socket area with the assumption
51:10 that either you're going to have an air
51:13 cooler sitting on your CPU that's going to generate enough passive air flow to
51:17 deal with the vrms here and here as well as the heat from the South Bridge and
51:21 the North Bridge which end up here so
51:25 that Paradigm has us pretty much until
51:28 now we might be returning to active
51:31 cooling on vrms if there's no other way to deal with this and honestly what this
51:37 kind of looks like to me is like Intel has said that like hey that we have a
51:42 plan for the roll out of core I9 so
51:45 we're going to do this here this here and it has to do with CPU yields it has to do with that honestly I wonder if
51:51 part of it has to do with that they just like actually on the engineering side

55:43 tethered like the Vive and the current Rift don't have good enough screens

55:57 which no one's going to really want to buy because they can just slip their thing into a Daydream or whatever which

62:58 OnePlus moving the motherboard and hence flipping the display panel in order to
63:03 accommodate their new dual lens camera module so they consciously rearrange the

63:13 normally only used for Diagnostics but they actually used this so they used a
63:17 field that you can that exists in Android where you can flip the display
63:21 180 degrees yeah um
63:26 in order to account for this rearrangement that's
63:30 so weird and so what users did was they manually changed other devices to be
63:36 upside down and the jelly scrolling
63:39 effect appeared on them now what I'd like to know because obviously if you
63:44 hold a display like this that doesn't have an upside down display installation
63:48 and go like this or you hold it like this and go like this it doesn't matter
63:51 so what I want to know is if this is just a matter of a simple optimization

67:12 astro gaming shirt and it was like by far the coolest one at the event and
67:17 like they had a really cool booth and they partnered with really cool people
67:21 so I could understand how if like you're just woful ignorant in terms of headsets
67:27 and you're like I went to this cool event and they had cool stuff I'm going
67:30 to tell my friends and we're all going to buy them you know what I mean
67:33 especially before like reviews on that kind of stuff was a big thing and easily
67:38 accessible lately though I don't know how they're still
67:41 around I don't know man apparently this
67:45 is great so uh apparently Logitech is
67:48 taking in and if if it ain't broke don't fix it approach

67:57 will keep separate teams and
