7:42 Logic for it um something along the lines of you know uh I started up
7:48 another Channel and was able to grow it very quickly because I'm that amazing um
7:53 and that was that was I think he called it yeah Jack Septic Eye 2 and the idea
7:58 behind creating that one was wanted another gold play button um meaning he
8:03 now has as many gold play buttons as we
8:07 do Shameless just because it's true what
8:13 you're saying is true just because we only have 15th as many subscribers on
8:17 our primary channel does not mean that we don't also have two golden play
8:21 buttons so there's that anyway he actually deleted the Jack septi 2
8:26 Channel as a way of fulfilling his bargain uh of the rationale that he was
8:30 offering up also seemed to have to do with some of the algorithmic changes
8:34 that YouTube has allegedly been making this has been kind of big news over the
8:39 last week or two plus depending on how
8:42 far back you go because we actually first started complaining about it
8:46 probably about um let me just see if I
8:49 can find if I can find that email chain
8:52 that I had going with our YouTube

9:10 that we were observing that the channel was getting um crushed out right but we
9:16 were observing that in particular our new videos were performing very poorly
9:21 and for those of you who were wondering if we were ever going to weigh in on this I guess I guess I wasn't going to
9:25 it wasn't on our topics for today but I will um so pretty much what happen
9:29 happen was our newer videos were not performing very well and uh YouTube
9:34 basically told us well then uh get good Noob and we kind of went uh okay I guess
9:41 that's pretty much we're trying yeah that's all you can do we really do get
9:44 up every day and try and get good it's
9:48 it's it's absolutely true my car was even doing this on the roads and I still
9:52 got here just so I could uh get good I guess yeah thank you for

11:11 reversal and it's more than just there was some content in the game that was
11:17 exclusive to Intel users it was actually
11:20 exclusive to Intel Core i7 users so uh
11:26 here we go the developers of Arizona sunshine for the HTC VI and the
11:30 controversy began over two pieces of content in game
11:35 um okay so the controversy over the two pieces of content began with a post on
11:39 the game team page asking why one machine the player owned could play The
11:43 Horde mode in single player and the other could not so the developer
11:49 explained that The Horde setting and apocalyptic mode were locked to machines
11:53 running core i7s until March of next
11:57 year we're talking a thre Monon
12:00 exclusivity period for buying a core i7
12:04 thoughts so so I can see that this was
12:07 not mentioned at all to anybody before the release of the game so which like
12:12 which direction was the deception in did they advertise all the content but then
12:17 everyone found out oh you have to have an i7 or was it the other way around
12:21 where they didn't advertise whatever the extra content was but then if you have
12:25 an i7 you found out after the fact hey there's all this extra stuff all of a
12:29 sudden um I I don't know if that matters a
12:34 whole lot either way but I could see people being extremely extremely upset
12:38 if they were promised something that they just weren't given so I from from
12:42 my mind I see your point but I actually don't really think that it matters yeah
12:48 it's deception like either way so not even if it's deception it's just a
12:53 really bad precedent I mean you look at
12:56 how upset The Gaming Community gets over
13:00 stuff like NVIDIA Gameworks where NVIDIA is legitimately going out and building
13:06 tools that game developers can use like
13:09 kind of copy paste I'm simplifying it obviously but can copy paste into their
13:13 game for some fire effect or some hair
13:17 effect or whatever the case may be look at how upset people are about the very
13:23 idea of a piece of gaming content not
13:27 being platform agnos tic at all especially the fact they
13:32 weren't open about it and here yeah I mean here the message is even worse so
13:37 vertigo games responded working with
13:40 Intel allowed us to create even more content than we originally planned
13:46 including these modes and the physics systems in the game making Arizona
13:51 Sunshine one of the richest VR experiences possible which is just
13:56 another way of saying Intel handed us
14:00 three big bags of money and we invested
14:03 those into our game and we agreed to lock down the game well at least parts
14:09 of the game for core i7 users only entirely artificially in exchange for
14:15 aforementioned money now if we're talking about a feature that they
14:19 implemented that straight up wouldn't work on other Hardware so something like
14:24 uh physx yeah where it's just like mind you okay physx is another
14:30 like or like H like hdr10 like there's some
14:34 things that just don't like there's some Hardware that just does not support it
14:37 sure okay okay outputting hdr10 to an
14:41 HDR display sorry that's only going to work on the latest Polaris gpus and
14:46 NVIDIA 10 Series yeah but this is more like it's an HDMI output limitation
14:50 right this is more like just an artificial limitation on purpose and
14:56 it's it's one of those things where like I've had
14:59 conversations with people at Intel uh
15:04 where and actually I you know what I'm probably at Liberty to talk about it
15:07 because the person in question uh is no longer working there you're going to go
15:10 with probably I'm going to go with probably yeah I'm going to go with probably I mean you're not you're not uh
15:15 legally allowed to counsil me up here anyway so I'm not that's that that
15:18 that's absolutely true yeah you're going to have to pass a whole different bar for that um so I have had conversations
15:26 with Intel where this gu and I don't know where he got it from but was
15:31 insisting to me that a core i7 was the
15:35 best VR experience to which I
15:38 replied I mean maybe in a completely immeasurable
15:45 way because a core i5 like a latest
15:50 generation core i5 especially going back I mean they enabled it for fifth sixth
15:55 and seventh generation core i7 so you even have to go back a generation
16:00 um so especially the latest generation core i5 I guarantee you is going to run
16:05 a game any game on the market right now
16:08 just as well as the latest generation core i7 you don't need eight threads to
16:13 game you just don't you just don't not yet maybe in time but as it stands now a
16:20 core i5 6600k will perform just as well
16:24 as a 6950x in pretty much any game now I
16:28 believe they may be some exception City skylines scales a little better it
16:32 scales a little bit better but it's not
16:35 the difference is like a couple of frames it's not ridiculous it's not the
16:38 difference between unplayable and the
16:42 richest VR experiences possible that's
16:45 not what happens there so fans
16:49 revolted most asking why this hadn't been mentioned before launch vertigo
16:53 games then basically ran to Intel went
16:56 yo this is actually causing more problems than the money could possibly
17:00 compensate for we really need to undo this because it's bad PR for you too
17:05 then they went back to the gamers apologized and unlocked the locked modes
17:09 for all players this reminds me a little bit of something a little bit of
17:13 something that Intel did I believe it was I think it was about a decade ago
17:17 maybe a little bit longer when they had they actually wrote their own compiler
17:21 for programmers I don't think a ton of people were using it but they found out
17:24 later on it would only take advantage of certain um CPU instruction capab ities
17:29 if it was an Intel processor the system was running even if it was even if it
17:33 was AMD and even if the AMD chip supported these instruction sets it just
17:38 wouldn't run and there was a huge controversy over that I remember and
17:41 they they were legally required to put a disclaimer on so so yeah it was it just
17:46 reminded me that a little bit I guess so yeah I mean this
17:52 is like I don't think it's quite I mean
17:56 okay the fact that it's not disclaimed very well is really really crummy but at least
18:01 they aren't handicapping the performance of someone else's system like at least
18:05 they didn't have the game developer you like like your example use a compiler
18:10 that's going to make the game Run worse on other things they just soft lock
18:14 they're also just like completely like denying people content though so you
18:19 know I guess it just depends on your perspective but definitely not good I
18:22 mean one way or another neither of us thinks it's good neither of us is
18:26 pleased neither were the gamers and you have to give at least a little bit
18:31 of credit where credit is due at least they came out reverse the decision and
18:35 now everyone has access to the content I just figured out why not very many
18:40 people are watching wow today it seems to be related to the fact that I forgot

19:21 so South Korea has effectively uh made
19:24 game modding illegal uh so they've passed an amendment into law with with
19:28 the intent of shutting down video game hacks and modifications and based on the
19:32 law manufacture or distribution of
19:35 programs that are not allowed by a game company or its terms of service or
19:40 actually against the law so this includes aim boders hacking programs
19:44 scriptors basically anything that's not allowed by the terms of service um the
19:49 punishment for this is actually is is theoretically pretty steep uh 5 years of
19:53 jail time or the equivalent of $43,000 in fines um part of this is in
20:00 response to um hacking communities for certain games particularly OverWatch um
20:03 hacking is run rampant with OverWatch in South Korea uh so blizzard has been
20:08 trying to take its own action against players that are doing the hacks but now
20:12 with this they're also going to have the full vacing of the South Korean
20:15 government so thoughts on
20:18 that so

20:25 um on the one hand do I believe that
20:29 being a jackass online should have real
20:33 world consequences when you are and if you
20:36 really break it down when you are effectively wasting someone else's money
20:42 you are robbing them of enjoying something that they paid for no you're
20:46 not stealing it from them you're not like stealing their game but let's say
20:50 for example someone um bought a a TV and
20:53 they brought it home and they put it in their living room and they wanted to
20:57 please don't ride a bicycle in the warehouse for the love of everything
21:00 that is good why do I have to say these things
21:04 safety meeting safety meeting yeah safety safety meetings Okay first Monday
21:08 of every month um like I actually have to do that
21:12 by law speaking of laws safety meetings anyway um what am I even talking okay
21:17 okay so I I see it as a kin to someone your neighbor buying a brand new cool TV
21:23 and he goes to watch Breaking Bad or something on it and you go over you you
21:29 barge into his house and you stand in front of it and you
21:34 go and you get all like cross-eyed and obnoxious because you haven't taken his
21:40 TV but you're depriving him of enjoying it and something for so I think being an
21:47 ass hat should have real consequences
21:52 when it impacts the lives and the
21:55 quality of life of other people
21:59 on the flip side government backing of
22:06 ulas well this is even that this is much more than government backing of a Ula
22:11 because if you violate a Ula let's say you're playing OverWatch or Starcraft or
22:15 whatever you do something that violates the to if so at least in the US if if
22:20 and I'm sure South Korea there civil remedies of South Korea too but you go to court and you say oh well this person
22:26 violated the to that's why we kicked them off and now there's litigation
22:29 about it but that's your usual remedy it's a contract remedy you can kick
22:32 people off for violating the T to so in
22:36 that sense there already is government backing but we're not just now they're
22:40 taking it out of the realm of private law and civil courts and we're saying
22:44 we're going to come like like law enforcement will come after you and you could go to jail which is just on a
22:49 completely other completely different level so right and we're talking again
22:53 we're talking about you know going to you know
22:58 presumably this is this is another gamer maybe even a gamer you know so let's say
23:02 you're buddies and you're being a jerk and using an Aimbot or whatever else so
23:05 this is a k to you being at your budd's house going in front of the TV and him
23:11 calling the cops and them not just
23:14 saying yo leave but them arresting you
23:21 what was it a fiveyear sentence potentially up to five years putting you
23:25 in jail for up to 5 years and finding
23:28 you the equivalent of like
23:31 $5,000 yeah so so so if you take it to
23:35 the real world being a jerk example you
23:38 can see how this is the wrong way to behave and there should be consequences
23:44 but you can also see how given the you
23:47 would you say my my example is fairly parallel it's yeah it's good I mean it's
23:52 I was actually having a conversation about an unrelated issue um with someone
23:55 earlier today about this that there's plenty of things that are frankly just
24:00 dick moves in society but that that we don't criminalize you know we say we say
24:05 this is bad and there might be some consequence for this but we're not going
24:08 to NE necessarily Chuck you in the jail Cale for it that's right I mean there's
24:13 there's a lot of stuff that is you know
24:16 uh public urination okay well that
24:19 actually is against the law but it is against the law but they but they throw you in the drunk tank for overnight or
24:25 whatever and they let you out MH
24:28 but but it's not a fiveyear sentence well sometimes some places put you on
24:32 the sex offense registry for that so you're in there with like the child
24:35 molesters and stuff maybe publication bad I understand what you're trying to
24:39 say though okay let's talk about like graffiti then okay so graffiti is is a
24:43 similar you are not you are not making it so someone's building doesn't
24:47 function anymore yeah it's just not a nice thing to do you're wasting their
24:51 time and potentially wasting their money property values will go down too which
24:55 is exact actually exactly what we're talking about wasting someone's time and
24:59 money so is it criminal yes but does it
25:03 get a 5-year jail term potentially no
25:07 mhm with that said do you think a big part of the reason why they might have
25:12 such a high maximum is not because they necessarily intend to enforce that kind
25:17 of thing for someone who installs an Aimbot and pawn some noobs or whatever I
25:22 my guess but for someone who's creating an Enterprise out yeah yeah I mean my
25:26 guess is that some person who's just doing something they think it's a joke
25:31 they wouldn't get that they probably I also read that this was an amendment to
25:35 something so maybe there's some other stuff that's punishable by a Max five
25:39 years that would be more serious I mean I don't I know extremely little about
25:44 how law in South Korea works but um it
25:48 reminds me of um a case a couple years ago in Georgia where I think there it
25:53 was I think it was a comp siiz student at Georgia Tech and they had just beaten
25:57 the University of Georgia which is like one of their big rivals I think in the football game and he hacked into ug's
26:02 computer system and put and just change put something funny on like one of their
26:07 like University web pages it wasn't anything super malicious but he got
26:10 charged criminally for that and taken in front of a judge and it kind of blew up
26:14 because I think he was facing five or 10 years in prison like at Max for that but
26:18 of course he didn't get that the judge was just like that wasn't good don't do
26:22 that again they put him in like some sort of diversion program and it was okay but um as far as so this is
26:28 probably something kind of similar but I guess if it is bad enough if you're winning some sort of huge Enterprise
26:33 then maybe they could come down on you so very interesting very very
26:39 interesting and there's also the uh the small matter of their president being
26:43 mired in like impeachment proceedings now too so I don't know how that's if
26:47 that would affect anything but there you

28:01 getting back to our getting back to our Watchdog story here in mid November a
28:06 French Finance regulator has accused had accused five Ubisoft Executives of
28:10 insider trading back in 2014 including the head of Ubisoft Montreal so
28:17 theor de fin handed down the fine ear
28:22 today Ubisoft has told Kotaku that the publisher will be appealing the judgment
28:28 they believe those involved didn't intentionally commit any crime so the
28:32 AMF is specifically accusing those execs of having prior knowledge of the
28:36 watchdog's delay and then taking advantage of that privileged information
28:40 to sell their shares before the value dropped I sure as hell would have sold
28:44 my shares before Watch Dogs came out oh
28:47 good lord I'm glad I don't didn't own any Ubisoft shares and I didn't know it
28:50 was going to be delayed and it was going to be a terrible Port because uh yeah
28:54 then I could be in trouble right now so the delay announcement caused Ubisoft
28:57 shares to dropped 25% in value back in
29:00 2014 Ubisoft is arguing that due to the processes and timetables involved in
29:04 game development those involved couldn't have known about the delay at the time
29:08 that they sold shares which to which I would say okay
29:13 maybe I don't run a major game developer
29:16 but to say that at any stage in a
29:22 project an executive wouldn't have any
29:26 ability to find find out if you know
29:30 we're somewhat on track or if we're going to be I how late was watch dogs
29:35 again I don't remember how late it was it was like really late it was really
29:40 late and really unfinished in a lot of ways which is another indicator that
29:45 they were more late than even they ended up being so to say that you know I would
29:52 have no way of knowing at an early stage in the pipeline of production of a video
29:57 project of our s whether it's going to be delayed is just kind of asinine um
30:03 this just seems like some butt covering because insider trading is sort of a big
30:07 deal um and based on the 1.2 million euro
30:12 fine apparently others agree so there's that MH that's not a small amount of
30:17 Euros that's many euros that's many euros that's over one million euros
30:23 yeah okay so here is some bad news for
30:28 Pebble owners specifically and Smartwatch enthusiasts in general if
30:34 there was any doubt left in your mind that the Smartwatch Market hasn't taken
30:39 off the way that uh Smartwatch makers
30:43 would have liked to believe that it was going to then this pretty much seals it
30:49 Fitbit formally announces that it is buying Smartwatch maker Pebble rumored
30:55 to be something to the tune of a $40
30:59 million acquisition making it about 15
31:03 million more than Casey neistat's
31:06 beam and Casey neistat so there you go

31:39 wife wants a new smartwatch she's actually running a uh Pebble time no
31:43 Pebble time original Pebble Pebble time I think don't look at me yeah sorry
31:48 she's running a pebble time I'm pretty sure uh the one with the color e in
31:51 display the first the plastic one though not the steel um and she really likes it
31:57 but it's not not particularly feminine and so she's been asking me to find her
32:02 like a really functional like a women's smart wom's Smartwatch and the Apple
32:08 watch is great if you like the iPhone
32:11 but um my wife doesn't like the iPhone
32:14 and right now there are not a ton of great options out there and um one of
32:19 the things that Pebble was doing differently is they weren't building on
32:23 Android Weare um so it was actually legitimately different and it was a
32:28 pretty good experience on both Android and iOS at least the last time that I
32:32 tried it um the other thing I'm disappointed
32:36 in is how this whole thing is is going
32:41 down with respect to supporting pebble's
32:44 existing customers so let me just see
32:47 here we go so Fitbit acquired the
32:51 technology but they are not acquiring
32:54 the hardware products so what that that effectively
32:58 means is Pebble is right now effective
33:02 like immediately when they announced this uh December 7th 2016 they are no
33:06 longer promoting manufacturing or selling any devices they'll continue to
33:11 work as normal no immediate changes to the pebble user experience will happen
33:16 but and this is the next bullet point Pebble functionality or service quality
33:21 may be reduced in the future so basically what that means is there will
33:25 be absolutely zero ongoing developments so Android you know uh what's Oreo or
33:32 you know whatever what what else is o oh

35:15 hard to do Pebble has existing inventory presumably that they are not selling
35:20 anymore all you have to do is allocate a
35:23 little bit of your customer care like a little hidden part of the website
35:27 somewhere and a little corner of your Warehouse to
35:31 Pebble stuff and kind of go okay we'll provide warranty support for x amount of
35:35 time or until all the pebble products are gone we'll do our best we'll provide
35:38 90 days or whatever the case may be um to Sheba when they acquired ocz they
35:43 continue to offer warranty support for the uh EOL ocz products it's in my
35:49 opinion the right thing to do but because at that point it's your product
35:52 that's right so I mean except that they didn't acquire the hardware products
35:58 so I think that's just pretty crappy um
36:01 and if you want any third party accessories then you can buy them on
36:04 like Amazon or Gadget wraps or whatever the case may be
36:08 so really don't like the way they handled this and um I I don't I'm not
36:14 really not sure what else to uh to say about it apparently jobs were offered
36:19 mostly to software engineers at Pebble
36:22 uh Pebble founder and CEO um will not be
36:25 staying on with Fitbit after the acquisition basically it's largely a grab for Pebble

36:34 platform bommer hope your Pebble doesn't
36:37 break it will at least maintain services so that existing Pebble devices continue
36:42 to work as normal but continue to work as normal is sort of a meaningless thing

52:48 the win HC Hardware conference in shenzen and they announced a range of
52:52 hardwar driven initiatives to modernize the PC and address two big goals
52:57 expanded support for mixed reality and to produce a range of ever more
53:00 efficient mobile always connected PCS powered by ARM processors so qualcom
53:06 powered Windows 10 um PCS will hit the market in 2017
53:11 with a full Desktop Windows 10 variant coming to ARM there will be a 64-bit
53:16 version running on qualcomm's latest and greatest processors so presumably the
53:20 Snapdragon 835 and the way that Microsoft describes it it will offer a
53:25 full Windows Experience with the ability to run not only universal Windows
53:29 platform apps from the store but regular win32 desktop applications it'll include
53:34 built-in emulation for 32-bit x86
53:38 applications and the emulation will be used only for application code the OS
53:42 itself itself and all system libraries will be native 64-bit ARM binaries
53:47 pretty freaking cool so actually no I had misunderstood an earlier part of the

56:22 be totally down for that in a Sleek device that lasts for like freaking 18

56:34 think of is if you need to run something a little bit more specialized because

56:40 still reduced instruction set so there are still going to be things that you
