3:04 that I can reveal that I have finally resolved all the issues that I had with
3:10 the streaming setup here um we are using the Razer siren Pro which for whatever
3:15 you guys always complained that the audio was too quiet and I think part of
3:19 the problem is that we're using microphones with a cardioid pickup pattern as two people and so we we
3:25 couldn't turn them up high enough without introducing Distortion siren Pro
3:28 works well for sum reason in this application I don't know why the other
3:33 thing is that we had a mishmash of capture cards from Elgato a media and
3:38 Black Magic including cards from their deck link as well as their intensity
3:42 lineup um it seemed like from week to
3:45 week one or the other could be responsible for everything being
3:49 completely bunged up we are now Consolidated we are using all epiphan
3:54 capture cards um a combination of them and we actually have more input devices
3:58 now so I can do this with Linus' screen or I can do this
4:04 with Luke's screen who so we can both screen share now also
4:09 this is a really funny bug that I hey we can prove that we're watching the show
4:13 now oh yeah that's true cuz people will see the chat on my screen um H so uh
4:19 this is a really funny bug that I was having with the Elgato card was where it
4:23 would take like 8 seconds to switch scenes so I would bring up the uh I
4:29 would bring up the article that we were talking about and it would be sitting
4:33 there and I wouldn't be able to change to my notes on it and I would always
4:36 just have to kind of kill 10 seconds after I clicked yeah so uh yeah this is
4:41 a pretty interesting article that I'm planning to talk to you about but I
4:45 don't have any my exact notes here's some kind of you know thing that I okay
4:49 yeah blah blah blah here's what's going on yeah so we're pretty much solved as
4:55 far as issues go I'm super thrilled and

5:28 yeah cuz I actually and this was really hard but I went home had a shower and
5:34 like scrubbed cuz I was trying to get spray tan off so I scrubbed a sunburn
5:40 when I got home from the shoot yesterday should we I scrubbed a little bit but
5:43 I'm not burnt as bad should we tell them what we were shooting and why your beard
5:48 is shaved why I have a how long till it's
5:52 going to be coming out it's going to be at least two to three weeks but should
5:55 we should we tease it anyway maybe we should tease it anyway I kind of think

10:25 topclassactions.com NVIDIA settles graphics card false
10:30 advertising class action so they've
10:33 agreed to a preliminary settlement that will resolve claims in a group of
10:37 proposed class action lawsuits that center around allegations that the
10:40 company misled consumers about the performance B tweeted it and uh quote
10:46 unquote storage capabilities of its product though it should be noted that I
10:51 wouldn't call vram Storage I already
10:55 posted that I wouldn't call vram Storage in sort of the strict sense of the word
11:01 um NVIDIA says then that it will pay
11:04 every buyer of a GTX 97
11:09 $30 and they will pay $1.3 million in
11:14 additional an additional additional attorney fees so there you go we had
11:21 talked about this at the time we had said we felt like a class action was
11:25 going to be pointless what are you going to get five bucks you know what $30
11:30 looks is decent $30 buys you an appy and
11:33 an entree but not a drink at a
11:38 restaurant and I just order Waters yeah
11:41 I drink water too so that's a good like big probably going to take some home
11:44 meal yep that's right that's right that's going to be your dinner and your
11:48 midnight snack while you're gaming on your gtx970 which is still a very good
11:52 card yep so you know I we again I don't want
11:57 to beat this dead horse anym than we already have you know like pure ghost
12:02 loads out of that horse at this point um
12:06 but the 970 is still a good card they
12:10 shouldn't have done that no I think they deserved this yep definitely um I didn't
12:16 think it was going to work cuz I thought they were going to get away with in the
12:19 legal Court like there's technically four there and there are like and there
12:23 are that's the funny thing about it is they it is misleading and they do
12:27 deserve it I can't imagine they saved a lot of money building the card this way
12:32 I don't I don't feel like it would be 30 bucks a card because they did put four
12:36 gigs of RAM on it like they they they bought the the memory they they put it
12:40 on there so they actually had to pay for the memory and then they had to pay crap
12:45 pay out to their customers as though they didn't so now yeah I don't know
12:49 lesson learned right don't don't screw with the internet so the overall
12:54 settlement amount was not publicly disclosed within the court papers it's
12:58 going to be a lot but NVIDIA did say that there would be
13:02 no cap on the total amount it would pay and they would pay all consumers who
13:06 purchased a 970 graphics card I guess I don't count cuz mine are review samples
13:10 that'd be pretty sick though if we could turn in our 970 for 30
13:14 bucks go get some dinner some appies pretty sweet I mean with the amount that
13:18 we had would you get I don't think we had that many 970s at least two yeah we
13:23 had yeah 60 bucks and it's US dollars so
13:26 like oh dang yeah $600 what's up you
13:32 know um that is pretty sweet though and
13:35 I'm happy that it happened this quickly and I know some people are going to be
13:39 like what like this happened forever ago
13:43 but these things sometimes take like what was it ddr2 or something there was
13:47 some like $15 rebate or $20 rebate on ddr2 purchases oh I don't know and it
13:52 happened like 10 years later something insane there was an Intel one that was
13:57 like six or seven years down the line everyone got 15 bucks or 10 $10 or
14:00 something like so 30 bucks is I feel a pretty good amount of money and it
14:05 happened relatively recently afterwards yeah it was the right it was the right
14:09 thing for NVIDIA to just settle it cuz that's why it got done so quickly was
14:12 that they settled it rather than dragging this out into a really long Court battle I mean to be clear I don't
14:17 think they'd have settled it if they thought they could win it but yeah um I
14:22 uh what was I going to say right there's no form up yet to like
14:28 apply to get your $30 just in case anyone's like scrambling trying to get
14:32 their money um I think this Top Class
14:36 actions website is going to post something about it once it's up um so
14:42 they're trying to get you to sign up for their newsletter I would probably just come back to this website instead of
14:46 signing up for their newsletter so basically um there were a total of 15
14:51 consumer class action lawsuits that were Consolidated in Northern California
14:56 NVIDIA denied all allegations of wrongdoing
15:00 and then entered into the settlement terms uh and agreed to the terms of the
15:05 settlement and then U the $30 is not
15:09 arbitrary it's calculated to represent a portion of the cost of the storage and
15:13 performance capabilities the consumer thought they was the consumers thought
15:17 they were obtaining when they purchased the card which what that's like around
15:20 like 11% of the cost yeah something like that a pretty pretty more than fair is
15:25 what I would call that cool speaking of
15:29 there's something to be said for like you think you buy a product and you don't get that and it wasn't even
15:34 necessarily as much about the money right so you should probably get more
15:38 than the difference which is probably what happened but I don't think that's usually how these things work I have no
15:43 idea so no all right let's move on to
15:47 our next topic here another lawsuit topic the original article here is from
15:51 extreme Tech I'm going to pull this up you want to post it y all right
15:55 Microsoft slapped with class action lawsuits over Windows 10 upgrade
16:07 practices so they're facing two more lawsuits over company over their
16:11 questionable upgrade tactics both suits are seeking class action status the
16:15 first one was filed in the US District Court of in Florida and alleges that the
16:19 Microsoft Windows 10 upgrade prompts violated laws governing unsolicited
16:25 electronic advertisements which is a really
16:29 interesting way of tackling it because
16:33 you could sort of make the argument that
16:37 and this is this is kind of getting into a pretty fuzzy area here you could sort
16:42 of make the argument that let's say apple putting in iTunes update
16:48 notification in the bottom of your screen all the time is like is like
16:53 advertising Impressions because they're showing you the Apple name and the
16:57 iTunes name and the and and there or
17:01 like if they had like a logo or something in there like you could you could almost take it one step further
17:06 and go but then it's like putting a brand name on something is that
17:10 advertising then if it's unsolicited because the
17:14 Windows 101 was an entire window that
17:17 popped up on your scre it wasn't like a notification in the corner it was like
17:22 Hey upgrade to Windows 10 and it did it all the time and would do it forcefully
17:26 okay but hold on a second so so I so yes
17:30 they basically put a billboard on your computer that is different yeah but they
17:35 weren't trying to sell you anything however in this day and age so
17:42 much software is free to play
17:47 that is there really a difference between an ad for installing the Twitter
17:54 app for example and an ad for installing
17:57 Windows 10 if Microsoft was making the argument that Windows 10 was uh Windows
18:03 8.1 Service Pack 4 or something like if
18:06 they just kind of said okay uh yes it's a service pack that makes everything
18:10 look the same oh by the way we're going to call it Windows 10 now like if they
18:14 weren't calling it a different product they might have gotten away with this
18:18 not being called advertising but if they are effectively
18:22 trying to get you to download and install a a different product from what
18:26 you have then I actually I kind of see that holding water yeah and the length
18:32 to how aggro they went about it m um all right so the second suit this
18:39 is more along the lines of what I expected from Windows 10 class action
18:43 lawsuits so this one alleges that Microsoft installed Windows 10 on users
18:47 computers without consent and they've already paid out $10,000 in a previous
18:52 US suit over similar circumstances and this is a case where because it's a
18:57 Windows operating system and not part of
19:00 video memory that still functioned but just like wasn't what I thought I was
19:05 getting this one I can see people getting significant payouts for being
19:11 put out by this situation where their computer doesn't work or their computer
19:15 doesn't work the way they expected I mean which I hope that happens because
19:18 I'd like to receive some money for the like half a day that I lost because of
19:21 that I mean and it could be a lot worse than that it could be you know but it's
19:26 only not worse than that because it was me yeah like if it I was I my system is
19:31 set up that it's not that big of a deal like if it's your you know I'm not going
19:34 to say your mom because your mom's fairly techsavvy if I recall correctly
19:39 she's like she wouldn't not be able to find the control panel because you
19:43 changed the version of Windows would she or like not be able to find her programs
19:48 she would know to look for the control panel okay like would she not be able to
19:51 find her programs she could find her like her Internet Explorer find internet
19:55 stuff she can all that so let's talk about if it's someone who legitimately
19:59 wouldn't be able to use their computer even if the upgrade worked correctly
20:04 there's going to be people saying I have like my mom would be fine yeah there's
20:07 going to be people out there though that would have not been able to use their
20:10 computer for potentially weeks I guarantee my mom would call me and be
20:13 like everything looks different I'm scared and on top of that would have had
20:17 to take it to a shop to have it restored to its pre- Windows 10
20:21 upgrade they could be paying a lot of money per instance in the case of that
20:26 $10,000 one they ended up buying her a new computer if I recall correctly like
20:29 it was a new laptop which I think is unjustified personally but I think
20:34 they're very much just trying to get it to go away but with that said the paperwork involved in having a computer
20:40 serviced by some shop somewhere like building a a service network
20:45 Countrywide and remember people could have been getting Windows 10 upgrades in
20:49 the middle of Tim Buck freaking 2 Kentucky
20:52 like it could be easier to just ship them a computer from dell.com yeah yeah
20:57 which is kind of Terri
21:00 um oh dear all right so I I'm upset
21:04 about that kind of stuff and I wish that like ah I don't know it's it's
21:08 frustrating and frustrating that it also wasn't
21:13 easier cuz like I'm trying to build some land rigs right now but like I don't
21:17 have enough cases and I'm trying to like get cases essentially for free so
21:21 there's been like delays on it and whatnot um so I haven't built all of
21:26 them yet I've built a couple of them but that means there's a few of them that I
21:30 haven't done operating system installs on yet so I guess they're just going to
21:34 stay on Windows 7 because I have keys for that I don't have keys for Windows
21:38 10 and I don't really want to buy more operating system keys for land
21:44 rigs that don't need it right everyone can run dx11 that's fine because dx12 is
21:49 kind of borked at the moment anyways yeah you're working on a video about
21:53 that right trying to yes trying to I'm going to leave it at that
22:01 there are certain reasons why I am not currently able to complete it that are
22:04 making me frustrated but I'll stay away from that I should
22:09 um I think I'm getting the rest of the information that I want on August 4th
22:14 but then I'm leaving for a while on August 5th so it's probably going to be
22:20 a bit Yeah but yes there's a video on
22:23 Vulcan the current state of Vulcan and dx12 that is on the way so Microsoft
22:29 told the Seattle Times that it believes these suits won't succeed although I
22:34 mean they have to say that what else are they going to say at this point one
22:37 quick thing that I want to interject someone in the chat said if Vulcan succeeds you won't need Windows 10 or
22:42 dx12 it's a good point Vulcan works on like everything Android Linux that's
22:47 true assuming that the game works there's only four games that supports
22:52 right now yeah one of them is dota so

22:59 nice no but no DOTA is a very important game but it's very easy to run and you
23:04 don't need like Oh I thought you meant specifically DOTA is a very important
23:08 game I didn't mean DOTA doesn't matter I mean like it being featured in Dota the
23:13 cool part of that mean means that it's very like you can play it on whatever
23:17 you want that part is cool cuz Vulcan is on everything right
23:22 okay context of that got a little weird sorry I was like wow so much hate no so
23:30 much salt it did not mean that at all
23:33 though is important game they've done really good thing for Esports I like how
23:37 they do their tournaments I just realized that the um
23:42 or like it only the most loyal of our viewers are watching right now oh you

23:59 Microsoft getting wrecked yeah yeah basically them what their statement is
24:04 still in there Microsoft stated Microsoft's
24:07 marketing scheme falls short of certain uh protections which must be afforded

24:16 I'll just pick off okay um so basically
24:20 they said that upgrades to Windows 10 are a choice not a requirement which is
24:23 one way of putting it I guess and that they offer free customer support to
24:27 those that run into trouble have you ever tried to contact Microsoft customer
24:30 basically the worst um I don't actually think I've had a worse customer
24:35 support thing from anyone they say
24:39 people who update to Windows 10 can roll back their prior system for 31 days
24:42 which doesn't help people who are not techsavvy and whose upgrades don't
24:45 complete successfully yeah or if it fails like mine did not completing
24:49 successfully yep um yeah so basically
24:52 the lawyer that filed the Florida lawsuit said that Microsoft's marketing
24:56 scheme he calls it falls short of certain protections which must be
25:01 afforded and then claims that the damages owed to Consumers who have
25:04 struggled with the new software May total tens of millions of
25:08 dollars wrecked and I'm kind of leaning
25:11 towards I hate to do this but I might have to agree with a
25:15 lawyer um cuz I'm sorry John yeah
25:19 because I am leaning towards him being more correct about this totally think
25:23 he's right I think it's going to cost them tens of millions of dollars yeah
25:27 100% what no no no it's all good John don't
25:31 worry everything's fine all right speaking of everything being good you
25:37 and I had some more experience than usual yeah with Dollar Shave Club razors

26:41 I have like these individual random really long ones random really long
26:45 hairs like it's bizarre but I shaved my
26:48 chest for the first time I used I believe it was the four
26:51 blade I I I actually borrowed luks we were at we were at the spray tan place
26:56 and I was like shaving my chest in the bathroom it was the executive very
27:00 strange experience was it no no it's not the executive that's the six blade one
27:04 oh yeah no no no no you have the one you have the step down yes the one in the

33:22 expected to do completely on their own I mean not completely on their own and
33:26 valve has their own just be clear as well valve has their own VR funding
33:29 stuff that they are doing so like both of those companies are doing awesome
33:34 things in terms of helping VR stuff so anyway um it's to summarize sort of this
33:39 was actually in an interview with Edge magazine so to so to summarize sween's
33:42 comments he basically goes okay look every PC game for the last few decades
33:46 has used win32 and it's been responsible for the vibrant software Market we have
33:50 now but also for malware any program can
33:53 be a virus and universal Windows platform is as an anti as an antidote to
33:59 that it's sandbox it's much more locked down but the risk is that if if
34:03 Microsoft convinces everybody to use it then they phase out win32 apps and if
34:08 they can succeed in doing that then it's a small leap to forcing all apps and
34:12 games to be distributed Through the Windows store which as we've seen
34:17 already has it just ter doesn't work
34:20 with higher frame rate doesn't work with anything like just crappy it's like
